Please read these Terms before using DeskFit. By downloading or using the app, you agree to them.
DeskFit ("the app") is provided by AcerLogic Educational Services, LLC ("AcerLogic," "we," "us"), Lake Oswego, Oregon, USA. These Terms of Use ("Terms") form an agreement between you and AcerLogic.
DeskFit provides general wellness and educational stretching guidance. It is not medical advice and is not a substitute for the judgment of a qualified healthcare professional. Consult your physician before beginning any new physical activity, especially if you are pregnant, recovering from injury or surgery, or living with any medical condition. Stop immediately and seek medical attention if you feel pain, dizziness, shortness of breath, or other discomfort. You use the stretches at your own risk.
The stretches reference reputable public sources (such as Mayo Clinic, Cleveland Clinic, Harvard Health, and the APTA). These citations are provided for reference and educational context. They do not imply that those organizations endorse, sponsor, or are affiliated with DeskFit or AcerLogic.
You must be at least 18 years old, or the age of majority where you live, to purchase a subscription. By using the app you represent that you meet this requirement.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use DeskFit on Apple devices you own or control, for your own personal, non-commercial use.
You agree not to misuse the app, including by reverse-engineering it except as permitted by law, interfering with its operation, or using it in any unlawful way.
DeskFit, including its software, the procedural figure, text, and design, is owned by AcerLogic and protected by intellectual-property laws. These Terms do not transfer any ownership to you.
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your specific health or fitness goals.
To the fullest extent permitted by law, AcerLogic will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the app, including any physical injury arising from performing stretches. To the extent liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.
You agree to indemnify and hold harmless AcerLogic from claims arising out of your misuse of the app or your violation of these Terms.
The app is licensed, not sold, to you, and your use is also subject to Apple's standard Licensed Application End User License Agreement (EULA). Apple is not responsible for the app or its content and has no obligation to provide support for it. Apple is a third-party beneficiary of these Terms and may enforce them.
We may update these Terms as the app evolves. When we do, we will revise the effective date above. Continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Oregon, except where applicable law provides otherwise.
